Q – How can one get to know that their case has been filed before the Allahabad High Court by their counsel?
The best way is to inquire from your counsel and the clerk of the said counsel. However, if they are out of reach, you may check the status of your case on the website. If the case is in the filing stage, it will receive a filing number.
Within one week from filing, in case of no defects, your case status will be displayed on the website. You may demand the filing number, token number, or case number, from the clerk or counsel, as the case may be.
To access the case status: Go to the website –> Status Reports –> Case Status Allahabad/ Case Status Lucknow –> Search by Case Number/ Search by Filing Number.
If you know the “advocate roll” of your counsel or his name, or in case of a criminal case, if you know the case crime number, then those means can also be deployed for finding your case status. If the case status is not showing, then it may mean that the website is not functioning optimally, and you may try again later.
Your case status is provided on the Allahabad High Court’s website. Primarily, you need three details, case type, case number, and year of filing for looking up your case status.
Q – What details are provided under the Case Status?
Once the case status is visible, details like the first hearing date, next hearing date or date of the decision, case status, coram (bench before your case is pending), bench type, and cause list type, can be accessed. You can also view the “listing history” of your case. If any orders have been passed, interim or final, they can be viewed in Portable Document Format (PDF) on the same window.
Names of the advocates representing you and the opposite party can also be viewed. If the name of the Counsel for the Opposite Party is not displaying, this means that either there is no counsel engaged or the status is not updated.
Q – What is the scheme of Lists and numbering of cases in Allahabad High Court?
Presently, the Allahabad High Court has three lists:
- Fresh List
- Supplementary Fresh List
- Additional/ Unlisted Cause List
Fresh List, as the name suggests, is a list of cases filed as fresh before the Allahabad High Court. These cases are taken by the bench on priority. They may be disposed of, or if there arises a need for inviting a counter affidavit, personal affidavit of respondent authority, or personal appearance, it may be listed subsequently. This is not an exhaustive list, hence, if the matter requires urgent consideration, the matter may be listed as fresh upon the order of the Hon’ble Court.
Supplementary-Fresh List is a list of fresh cases which were being heard by the Court but adjourned for any reason viz. paucity of time, or for filing some documents, or direction to respondents to seek instructions. Such cases come up as supplementary fresh when the Hon’ble Court deems them important so that they may be heard as fresh only for achieving the ends of justice.
Additional/ Unlisted Cause List is a list of cases which have been heard by the Hon’ble Allahabad High Court, and are pending for want of exchange of pleadings, final hearing, or some other reason.
Fresh Cases either in the fresh list or supplementary fresh list are numbered from 1 to 3000.
Additional List cases numbered from 3001 to 8000.
In the Allahabad High Court, you may also need to file applications for various purposes. Some common examples are listing applications, impleadment applications, substitution applications, etc. Such cases are numbered from 8001 onwards and are colloquially referred to as Application for Orders. Moreover, Correction Applications are numbered from C-1 onwards in a completely different notation.
Q – How can I access the Cause List?
The Allahabad High Court publishes a Daily Cause List for each day the Hon’ble Court is in session. The Daily Cause List comprises all the cases listed before the Hon’ble Court that day, including fresh cases, additional cases, and supplementary cases.
To access the Cause List for the day, follow the chain below:
Website –> Cause List –> Cause List Allahabad/ Cause List Lucknow Bench –> Combined Cause List –> Choose Listing Date; Choose Court / Counsel (whichever information is provided to you) –> Select the court number from the drop-down menu/ or put in the name of your counsel.
The link to Cause Lists for Allahabad High Court is here.
The chain ending with the court number will provide you with all the cases listed in the specific court you are interested in whereas, the chain ending with the advocate name will fetch you a list of all cases listed on that day in which your counsel is engaged.
Q – How can I know the date of the listing of my case before the Allahabad High Court?
For the date of listing of your matter, you must check the case status on the website, and then cross-check from the cause list of the day.
If the case status is not updated and the next date of listing does not show, it means that it has not been updated.
Sometimes, the Hon’ble Bench fixes the date for the matter, and the said date can be found in the order. Such matters are called Date Fixed Matters (DF). All the orders are accessible from the case status window. You can also download orders in your case by separately accessing only judgments, under the judgments/ orders section.
Sometimes, in case of additional/ unlisted matters, the next date of listing does not show as the matters fall out of rotation. To list the matter, you must consult your counsel to file a Listing Application before the Hon’ble Court, wherein you have to present your case and the urgency for listing the matter so that the matter may be heard and decided on merits.
Q – How can I know if my case is pending before the Allahabad High Court?
The case status is presented as either pending or disposed of. If the case status is displayed as “pending”, then your matter, as obvious, is pending. In case it shows “disposed”, then the matter has been disposed of through a final order. There are various sub-categories, which clarify if the matter has been disposed of after deciding on merits, or otherwise.
Q – What do I do if my case is disposed of by Allahabad High Court?
If your case has been disposed of by the Allahabad High Court, the certified copy of the Order can be obtained from the Hon’ble Court.
The further course of action must be decided after proper and thorough consultation with your counsel. If the order is in your favour, you must present the certified copy of the order wherever you will be given relief.
If, on the other hand, the order is against you, the remedy lies in the form of various forms, eg. Special Appeal before the High Court, Appeal before the Supreme Court, etc. Consult a legal counsel to chart out the future course.
Q – What if I want to withdraw my case from the Allahabad High Court?
To withdraw your case, a withdrawal application is required to be filed before the Hon’ble Court. There may be various reasons for the withdrawal of the case, eg. Matter rendered infructuous, prayer granted by other authorities to which direction sought, the alternative remedy available, legally unsustainable remedy opted, or any other reason etc. In some cases of Incomplete pleadings, the Hon’ble Court may grant the prayer for withdrawal with the liberty to file a fresh petition with complete pleadings.
Q – How can I get my matter referred to the mediation centre of Allahabad High Court, and what is the procedure in this regard?
In matrimonial, commercial, or other matters, where a solution can be obtained via alternative remedy of mediation, upon prayer for referral of the matter to the Mediation and Conciliation Centre, Allahabad, the Hon’ble Court may refer the matter for mediation.
The Hon’ble Court may further give instructions to the party to pay a definite amount of money for the initiation of the mediation, and thereafter, notice is issued to both parties for mediation. If the mediation is successful, then the settlement is filed, and the case is disposed of.
However, if mediation fails, the case is remitted to the Hon’ble Court, which decides the matter on the merits.
Q – How can I access interim orders or final orders in my case online?
To download the judgments passed in your case, you may open:
Website –> Judgments/ Orders –> Judgments/ Orders –> Opt Search Method.
There are various search methods, eg. Case type, Case number, judge name, judgment date, counsel name, etc. Select the search method according to the information that you have. Fill in the details, and download the judgments in pdf format or read online.
